US Sentencing Commission releases new compassionate release data and notes upcoming hearing and meeting

July 30, 2025

A busy summer continues for the US Sentencing Commission.  A couple of weeks ago, as detailed here, the Commission conducted a “Public Hearing on Retroactivity” to “gather testimony from invited witnesses concerning whether to designate as retroactive certain 2025 guideline amendments.”  Next week, as detailed here, the Commission has scheduled a “Public Hearing on Methamphetamine” to hear “information from invited witnesses on methamphetamine, including its chemical structure, pharmacological effects, trafficking patterns, and community impact, and the differences, if any, between methamphetamine of varying purity levels.”

In addition, on August 6, the Commission will conduct a Public Meeting which has these key agenda items: “Possible Vote on Final 2025–2026 Policy Priorities” and “Possible Vote on Retroactivity of Certain 2025 Amendments.”  And, last but certainly not least, the Commission today released its latest “Compassionate Release Data Report,” which is availble here.  (I will be interested to see if any of the briefing to the Supreme Court in the pending compassionate release cases of Fernandez and Carter/Rutherford will make use of any of the USSC data.)
